Terms of Service — HEDGE_OC

Last updated: 24/08/26

Please read these Terms of Service ("Terms") carefully before using the website (the "Site") or purchasing any product from HEDGE_OC ("we," "us," "our"). HEDGE_OC sells and ships to customers worldwide. By accessing the Site, placing an order, or otherwise using our services, you ("you," "the customer," "the user") agree to be bound by these Terms in full, regardless of your country of residence. If you do not agree, do not use the Site or place an order.

1. Who We Are

HEDGE_OC is an independent streetwear label operating out of London, United Kingdom. trading as a sole trader

Contact: studio.hedgeoc@gmail.com

2. Nature of Our Products — Print-on-Demand

2.1 All products sold by HEDGE_OC are manufactured on a print-on-demand basis. No item is held in pre-made stock. Each order triggers a new production run specific to that order.

2.2 Products are fulfilled by a third-party print-on-demand partner ("the Fulfillment Partner"). While HEDGE_OC designs, curates, and sells all products, physical production, quality control at the point of manufacture, and shipping logistics are carried out by the Fulfillment Partner on our behalf.

2.3 Because each item is produced specifically for your order, minor variations in colour, print placement, and fabric texture between what is shown on the Site and the finished product are normal and expected, and do not, on their own, constitute a defect.

2.4 By placing an order, you acknowledge that you are purchasing a made-to-order, personalised item and not a mass-produced item drawn from existing stock.

3. Orders, Pricing, and Payment

3.1 Prices are displayed in the currency shown at checkout based on your location or selection, and may be converted from our base currency (GBP) using exchange rates determined by our payment processor at the time of transaction. These conversions are estimates and the amount actually charged may vary slightly depending on your card issuer's exchange rate and any foreign transaction fees they apply. Prices are inclusive of applicable taxes unless stated otherwise at checkout.

3.2 We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, pricing errors, unauthorized or illegal activity, or unavailability of materials from our Fulfillment Partner. If we cancel an order after payment has been taken, you will receive a full refund of the amount charged.

3.3 Payment is processed at the time of order through our third-party payment processor(s). We do not store your full payment card details.

3.4 In the event of a genuine pricing or listing error (for example, a product listed at an incorrect price due to a technical fault), we reserve the right to cancel the affected order and refund you in full, even if payment has already been confirmed.

4. Shipping and Delivery

4.1 We ship worldwide. Shipping costs, if any, are calculated and displayed at checkout.

4.2 Standard production time is 5–8 business days before an order is dispatched, in addition to carrier transit time. Estimated delivery windows shown at checkout are estimates only and are not guaranteed delivery dates.

4.3 Risk of loss and title for products purchased passes to you upon our Fulfillment Partner's delivery of the item to the carrier.

4.4 We are not liable for delays caused by customs processing, carrier disruption, incorrect address information provided by you, or other circumstances outside our reasonable control. It is your responsibility to provide a complete and accurate shipping address at checkout.

4.5 For international orders, you are responsible for any import duties, taxes, or customs fees levied by your destination country, except where our shipping method is explicitly stated as inclusive of these costs (Delivered Duty Paid) at checkout.

4.6 We reserve the right to decline shipment to any country or region where we are legally prohibited from trading, including countries subject to UK, EU, or UN trade sanctions or export restrictions. It is your responsibility to ensure that importing our products into your country is lawful; we are not liable for items seized, refused, or destroyed by customs authorities as a result of destination-country import restrictions.

4.7 You must be of legal age to enter into a binding contract in your country of residence to place an order. If you are placing an order on behalf of a minor, you confirm you have the necessary authority and consent to do so.

4.8 EU Responsible Person. In accordance with EU Regulation 2023/988 (the General Product Safety Regulation), the following economic operator is established within the European Union and is responsible for our products placed on the EU market:

This information is also displayed on product packaging, parcel documentation, or accompanying materials as required by law.

5. Cancellations, Returns, and Refunds

5.1 Right to Cancel. Where applicable law grants you a statutory right to cancel an order (for example, the 14-day right to cancel under the UK Consumer Contracts Regulations 2013, or equivalent rights under the EU Consumer Rights Directive or your local consumer protection law), that right generally does not extend to goods made to your specification or clearly personalised — which includes all HEDGE_OC products, as each is manufactured specifically for your order once placed. By placing an order, you acknowledge and consent to production beginning promptly, and that any statutory right to cancel for a change of mind is accordingly limited as described here, to the extent permitted in your jurisdiction.

5.1a International Consumers. These Terms are intended to operate consistently with UK law, under which our business operates. However, if you are purchasing as a consumer from outside the United Kingdom, you may also have additional statutory rights under the mandatory consumer protection law of your own country that cannot be limited or excluded by these Terms. Nothing in this document is intended to override any such non-waivable right where it applies to you. If any provision of these Terms conflicts with a mandatory consumer protection law in your jurisdiction, the local mandatory law will prevail for that provision only, with the remainder of these Terms continuing to apply.

5.2 Faulty, Damaged, or Incorrect Items. Nothing in these Terms affects your statutory rights under the UK Consumer Rights Act 2015, or equivalent mandatory consumer protection rights in your own country of residence where applicable. If an item arrives faulty, damaged in transit, or materially different from what you ordered, you are entitled to a repair, replacement, or refund as appropriate, regardless of where you are located. To claim this, contact us at studio.hedgeoc@gmail.com within 14 days of delivery, including your order number and clear photographic evidence of the fault or damage.

5.3 Non-Returnable Circumstances. We do not accept returns or offer refunds for:

  • Change of mind on a correctly produced, non-faulty item;
  • Incorrect size selected by the customer where accurate sizing information was provided at the point of purchase;
  • Normal variation inherent to print-on-demand manufacturing as described in Section 2.3.

5.4 Approved refunds will be issued to the original payment method within a reasonable time following approval, and may take additional time to appear on your statement depending on your payment provider.

6. Intellectual Property

6.1 All designs, artwork, logos, mascots, typography, product photography, and site content are the intellectual property of HEDGE_OC and are protected by applicable copyright, trademark, and design right laws. This includes but is not limited to all original character/mascot artwork, bilingual typographic treatments, and brand marks appearing on the Site or on products.

6.2 Purchasing a product does not transfer any intellectual property rights to you. You may not reproduce, redistribute, resell, modify, or create derivative works from HEDGE_OC artwork or branding without our prior written consent.

6.3 Any unauthorized commercial use of HEDGE_OC intellectual property, including counterfeit production, may result in legal action.

7. Acceptable Use of the Site

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to any part of the Site, our systems, or related networks;
  • Interfere with or disrupt the Site's functionality or security;
  • Use automated systems (bots, scrapers) to access the Site without our express written permission;
  • Submit false, fraudulent, or misleading information when placing an order.

We reserve the right to suspend or terminate your access to the Site at our discretion if we believe you have violated these Terms.

8. Third-Party Services

The Site and our order fulfillment process rely on third-party service providers, including but not limited to our e-commerce platform, payment processors, and print-on-demand Fulfillment Partner. We are not responsible for the acts, omissions, downtime, or policies of these third parties beyond our reasonable control, though we will act in good faith to resolve issues arising from their services where they affect your order.

9. Disclaimers and Limitation of Liability

9.1 The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, other than those which cannot be excluded under the UK Consumer Rights Act 2015 or other applicable mandatory law.

9.2 To the maximum extent permitted by law, HEDGE_OC's total liability to you arising out of or in connection with your order or use of the Site — whether in contract, tort (including negligence), or otherwise — shall not exceed the total amount paid by you for the relevant order.

9.3 We are not liable for any indirect, incidental, special, or consequential loss, including loss of profit, loss of data, or loss of opportunity, arising from your use of the Site or purchase of our products, except where such exclusion is not permitted by law.

9.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

10. Indemnification

You agree to indemnify and hold HEDGE_OC, its owners, and affiliates harmless from any claim, demand, loss, or damage, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Site.

11. Privacy

Your use of the Site is also governed by our Privacy Policy,  which explains how we collect, use, and protect your personal data in accordance with UK GDPR and the Data Protection Act 2018.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, legal requirements, or operations. The version in effect at the time you place an order will govern that order. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

13.1 These Terms, and any dispute arising out of or in connection with them or your use of the Site, are governed by the laws of England and Wales, regardless of your country of residence, except where mandatory local consumer protection law requires otherwise as described in Section 5.1a.

13.2 You agree that any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that: (a) if you are a UK consumer resident elsewhere in the UK, you may also bring proceedings in your local courts; and (b) if you are a consumer resident in the EU or another jurisdiction where mandatory law grants you the right to bring proceedings in your own country's courts regardless of this clause, that right is not excluded by this section.

13.3 We choose a single governing law and forum, rather than adapting to each customer's home jurisdiction, because HEDGE_OC is a small independent business based solely in London — this is standard practice for businesses of our size selling internationally, and does not remove your locally guaranteed consumer rights as clarified in Section 5.1a.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
